Spring into Action 2024 Terms and Conditions

READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING. YOU WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS AND AGREED TO BE BOUND BY THEM WHEN PARTICIPATING IN THIS PROMOTION. AMONG OTHER THINGS, THESE TERMS AND CONDITIONS INCLUDE LIMITATIONS OF YOUR RIGHTS AND REMEDIES.

1. The Promotor of this offer is Certas Energy UK Limited (Company number 04168225) of 1st Floor Allday House, Warrington Road, Birchwood, United Kingdom, WA3 6GR (“Promotor”).
   
   
2. This promotion is open to the Promoter’s customers (“Participants”) who are directly sent a promotion email from the Promoter (“Promotion Email”).
   
   
3. To be eligible to obtain the benefits of the promotion, the Participant must:
   
   

1. be over 18 years of age;
2. comply with these terms and conditions;
3. have received a Promotion Email from the Promotor;
4. place an order for 1000 litres (“Minimum Order Volume”) or over, of any Product type; and
5. place an order during the Promotional Period;

(together the “Eligibility Criteria”).

4. For the avoidance of doubt:
   1. orders of more than one Product type which in aggregate are greater than the Minimum Order Volumes (as set out above) will not satisfy the Eligibility Criteria;
   2. to meet the Minimum Order Volume (as set out above), the Participant’s order must be placed in one transaction; multiple individual orders will not meet the Eligibility Criteria; and
   3. the Participant will not be able to receive more than one Incentive Item during the Promotion Period (i.e. if the Participant order multiple Products which meet the Eligibility Criteria, the Participant will only be eligible to receive one Incentive Item).

5. The Products mean:
   1. Kerosene (041/ 341);
   2. Therma35 (261);
   3. Gas Oil (004);
   4. Derv (078/431);
   5. HVO (402/429); and
   6. GTL (296/267).

6. If the Participant meet the Eligibility Criteria then they will receive the following (the “Incentive Item”):

“M series M-3 Wireless Bluetooth speaker, the RRP value of which is £50.00”

7. By submitting to the promotion, the Participant confirms that they are eligible to do so and eligible to claim any incentive. The Promoter may require the Participant to provide proof that they are eligible to enter the promotion.
   
   
8. Entries on behalf of another person will not be accepted, and joint submissions are not allowed. Likewise, submissions made via a customer’s associated companies in its group, its agencies or anyone else professionally connected with them will not be accepted.
   
   
9. The promotion opens on 18/04/2024 and closes on 31/05/2024 (the “Promotional Period”). Participants can only enter the promotion during the Promotion Period.
   
   
10. Incentive Item fulfilment will take place between 01/05/2024 and 14/06/2024 (the “Fulfilment Period”) and only after the delivery of the fuel order.
    
    
11. The incentive is non-transferable and cannot be substituted for a cash alternative or used against an alternative product. Unless stated, discounts cannot be combined.
    
    
12. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
    
    
13. The incentive cannot be used in conjunction with any other promotion.
    
    
14. The Promoter does not accept any responsibility if Participants cannot take up the Incentive Item.
    
    
15. The Promoter has the right to disqualify any entry not made in accordance with these terms and conditions, which it has reason to believe has been made in bad faith or if the Participant’s conduct is contrary to the spirit or intention of the promotion. The Promoter is entitled to do this on the basis of a suspicion and is not bound to inform the Participant or to provide proof.
    
    
16. The Promoter reserves the right to replace the incentive with an alternative of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so.
    
    
17. The Promoter’s decision regarding any aspect of the Promotion is final and binding and will not enter into correspondence with the Customer (or their representatives) about it.
    
    
18. Excluded products will not count towards any qualifying conditions for offers and will not benefit from any promotional discount. All promotions are subject to availability and while stocks last.
    
    
19. To the maximum extent permitted by law, the Promoter shall not be liable for any loss and/or personal injury suffered by the Participant as a result of their participation in the promotion.
    
    
20. The Promoter reserves the right to withdraw, amend or temporarily suspend the promotion at its absolute discretion, provided that it shall not exercise this right unreasonably. The Promoter shall not be obliged to provide notice of the withdrawal.
    
    
21. The Promotor will withdraw this promotion once 180 Incentive Items have been awarded.
    
    
22. The Promoter reserves the rights to modify and amend these terms and conditions from time to time during the promotion.
    
    
23. The promotion and these terms are governed by English law and subject to the exclusive jurisdiction of the English and Welsh courts.

25. IMPORTANT DATA PROTECTION INFORMATION:

Please note that the Promoter shall disclose the following Participants’ data to Prizeshark Ltd (a third-party prize fulfilment provider): Participants’ name, email address and the address nominated, in order to receive the Incentive Item. For the avoidance of doubt, Participants’ data will only be shared for the sole purpose of Incentive Item fulfilment related to the promotion and will not be used for any other purpose or shared with any additional parties without the Participant’s consent.
